CORAM: HON'BLE MR. JUSTICE MANOJ JAIN O R D E R % 08.09.2026 1. Applicant seeks regular bail in case arising out of FIR No. 0430/2016 dated 28.04.2016, registered at P.S. Tilak Nagar for commission of offence under Section 302 IPC. 2. As per the applicant, he was arrested way back on 29.04.2026 and his incarceration, as on date, is of around 9 ½ years. 3. It is also submitted that earlier the applicant had filed an application seeking bail and his such application (BAIL APPLN. 3939/2024) was though dismissed by this Court on 12.03.2025, it also directed learned Trial Court to expedite the recording of the evidence and to make best endeavour to conclude the same within six months from the receipt of the order. 4. He submits that the trial is yet not over and a period of around 18 months has expired after the abovesaid order. This is a digitally signed order. Learned APP for the State though admits that the trial is still not over but supplements that only Investigating Officer is left to be cross-examined and all the other witnesses have already been examined. 6. There are three accused in the abovesaid case. 7. One of them is juvenile offender. The prosecution is not aware about the status of the enquiry pending before Juvenile Justice Board. The other co-accused, who is also facing trial for offence under Section 302 read with Section 34 IPC, is on bail. He was granted on bail by this Court on 26.02.2024. A copy of such bail order has been shown during the course of the arguments which indicates that while granting bail to the abovesaid co-accused, this Court had also considered the fact that two material eye-witnesses had not supported the case of prosecution. 8. Be that as it may, fact remains that the period of incarceration is substantially high and despite there being a specific direction given by this Court, the trial is yet not over. 9. Keeping in mind the overall facts of the case and the abovesaid incarceration period, albeit, without expressing any opinion over the merits of the case, the applicant is, hereby, directed to be released on bail on his furnishing personal bond in a sum of Rs.30,000/- with two sureties of like amount, subject to satisfaction of learned Trial Court/CMM/Duty Magistrate with the following conditions:- a) Sureties would be local. b) Applicant shall appear before the learned Trial Court regularly on date(s) fixed. c) Applicant/accused shall provide his mobile number to the investigating officer and shall keep the same operational all the time, till the disposal of the case. d) Applicant shall not try to contact any of the prosecution This is a digitally signed order.
