The grievance of the petitioner is directed against shifting of an electricity pole from the premises of the petitioner. It is an admitted position that there are private disputes by and between the petitioner and the private respondent. Pursuant to the order of this Court, WBSEDCL has also caused an inspection. It appears from the report filed by the WBSEDCL that though both the premises are enjoying the electricity connection, there are disputes in respect of shifting of the existing pole. In view of the nature and dispute raised by the parties, WPA 2718 of 2026 stands disposed of by directing the concerned District Magistrate to consider the grievance of the
2 petitioner and re-examine the entire case for shifting of the pole as claimed by the petitioner. In carrying out the above exercise, the District Magistrate is directed to give notice both to the petitioner and the private respondent as well as WBSEDCL and pass an order within a period of twelve weeks from the date of communication of this order. Both parties are directed to communicate this order to the concerned District Magistrate.
