In this writ petition, the petitioner-Judgment Debtor has called in question the order dated 28.11.2025 passed by the LXVIII Addl. City Civil and Sessions Judge, Bengaluru (for short ‘Executing Court’) on application i.e., I.A.No.1/2024 filed by the Judgment Debtor under Section 151 of CPC, in Ex.No.357/2024, whereby the said application has been rejected. 2. For the sake of convenience, the parties are referred to as per their ranking before the Executing Court. 3. The Decree Holder initiated execution proceedings in Ex.No.357/2024 before the Executing Court seeking for enforcement of the compromise decree dated 09.09.2023 drawn by the Lok Adalath in O.S.No.2857/2022. During the pendency of the execution petition, the Judgment Debtor filed the application under Section 151 of CPC seeking direction to the Decree Holder to produce original - 3 - HC-KAR NC: 2026:KHC:23962 WP No. 14107 of 2026 title deeds in respect of the execution petition schedule property. The Executing Court, by impugned order dated 28.11.2025 has dismissed the application. Aggrieved by the same, the present writ petition is filed. 4. A perusal of the compromise decree reveals that there is no clause imposing any condition or obligation on the Decree Holder to produce the original title deeds of the schedule property before the Executing Court. In the absence of such a stipulation, the Executing Court was justified in rejecting the application filed by the Judgment Debtor. 5. Viewed from any angle, there is no error or illegality in the impugned order passed by the Trial Court warranting interference by this Court. 6. Accordingly, the writ petition is dismissed. 7. However, this order will not come in the way of the petitioner-Judgment Debtor to file an application seeking - 4 - HC-KAR NC: 2026:KHC:23962 WP No. 14107 of 2026 for implementation of the compromise decree in terms of the compromise petition. 8.
