W.P.(C) 13002/2026 3. By way of the present petition, the petitioner is seeking following prayers: “ a) Issue an appropriate writ, order or direction directing Respondent No.1 ie. National Medical Commission to forthwith implement the judgment dated 09.08.2023 passed by this Hon’ble Court in W.P.(C.) No.10394/2020 by recommencing and concluding the remanded disciplinary proceedings in accordance with the directions contained therein; b) Issue an appropriate writ, order or direction directing Respondent , No.1 to issue notice to all concerned parties, including the Petitioner, afford them an effective and meaningful opportunity of hearing, and thereafter pass a fresh, reasoned and speaking order, strictly in accordance with law and uninfluenced by any extraneous consideration; c) Issue an appropriate writ, order or direction directing Respondent No.1 to This is a digitally signed order. The Order is downloaded from the DHC Server on 09/09/2026 at 11:52:30 conclude the remanded disciplinary proceedings within a fixed and time- bound period, as may be deemed fit by this Hon’ble Court; d) Direct Respondent No.1 to complete the remanded proceedings before an officer/Bench competent under the National Medical Commission Act, by granting due notice to all parties and by passing a reasoned order dealing with the submissions advanced by each party. e) Issue an appropriate writ, order or direction directing Respondent No.1 to file a detailed affidavit/status report before this Hon’ble Court explaining: i) the steps taken towards implementation of the judgment dated 09.08.2023; ii) the reasons for the continued non-compliance and delay in concluding the remanded proceedings; iii) the present stage of the proceedings and the proposed timeline for their conclusion; and iv) the name and designation of the officer(s)/authority responsible for ensuring compliance with the judgement dated 09.08.2023, together with an explanation for the failure to implement the directions issued by this Hon’ble Court within a reasonable period. f) Direct Respondent No.1 to place the entire original record of the remanded proceedings before this Hon’ble Court, including all file notings, proceedings, notices, correspondence and orders, if any, passed pursuant to the judgment dated 09.08.2023; g) Award exemplary costs against Respondent No.1 for compelling the Petitioner, despite a binding judgment in her favour, to repeatedly invoke the extraordinary jurisdiction of this Hon’ble Court solely to secure implementation of judicial directions and, if this Hon’ble Court finds deliberate or unexplained default, to identify the officer(s) responsible for such inaction and pass appropriate directions in accordance with law.” 4. After hearing learned counsels appearing on behalf of the petitioner and in view of the issue involved in the instant petition, this Court finds it appropriate to direct that the present petition filed before this Court be treated as a representation on behalf of the petitioner, and the respondents are directed to decide the same, within a period of eight weeks from date, under intimation to the petitioner herein. 6.
