A sum of Rs.1,98,000/- paid by way of cash by the learned counsel for the petitioner to the learned counsel for respondent. The same is acknowledged in the order. 3. Learned counsel for the parties have filed a joint memo, which reads as under:- JOINT MEMO The counsel for petitioner and respondent humbly submits as under:- 1. The above revision petition is filed by the petitioner impugned judgment dated: 15.09.2025 passed in Criminal Appeal No. 19/2025 on the file of 1 Additional District and Sessions Judge, Bengaluru Rural District, Bengaluru thereby dismissed the criminal appeal filed by the petitioner by confirming the impugned judgment of conviction and sentence dated: 13.05.2024 passed in C.C. No. 4211/2023 on the file of Additional Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru. 2. The petitioner humbly submits that after hearing the above revision petition, this Hon'ble court was pleased to suspend the judgment of sentence and order of conviction passed by the trial court with a condition to deposit the 50% of the fine amount on 08.01.2026 inclusive of amount - 4 - HC-KAR NC: 2026:KHC:23356 CRL.RP No. 1763 of 2025 already deposited if any before the trial court within a period of four weeks from today and directed to execute bond for a sum of RS. 50,000/- with one surety to the satisfaction of trial court. 3. The petitioner and respondent humbly submits that in view of the intervention of elders and well-wishers to solve the dispute/issues raised between the petitioner and respondent to put an end to that dispute/issue. Hence the petitioner and respondent are jointly filing the above Joint memo on the following terms:- 4. The petitioner submits that, the petitioner agreed to pay total sum of Rs. 3,00,000/- (Rupees Three Lakhs Only) to the respondent out of Rs. 5,15,000/- as ordered by the trial court in the following manner:- a. The petitioner has agreed to pay Rs. 1,98,000/- (One Lakhs Ninety Eight Thousand Only) to the respondent herein by way of cash to be paid before this Hon'ble court, failing which the respondent is at liberty to recover the same from the petitioner by following due process of law. b. The respondent agreed to receive sum of rupees 1,02,000/-(Rupees One Lakhs Two Thousand Only) which has been deposited before trail court. 5. The petitioner has no objection to withdraw sum of Rs. 1,02,000/- (Rupees One Lakhs Two Thousand Only) by respondent which is deposited before the trial court in C.C. - 5 - HC-KAR NC: 2026:KHC:23356 CRL.RP No. 1763 of 2025 No. 4211/2023 on the file of Additional Chief Judicial Magistrate, Bengaluru rural district, Bengaluru. 6. The said joint memo is filed before this Hon'ble court after obtaining instructions from the petitioner and respondent and the terms of the Joint Memo was understood by the petitioner and respondent without any undue influence, coercion or compulsion and pressure from anybody. Wherefore the petitioner humbly prays that this Hon'ble court may be pleased to acquit the petitioner for the offence punishable under section 138 of NI Act by allowing the above Joint memo the interest of justice. 4. Placing joint memo on record, revision petition stands disposed of. 5. Amount in deposit is ordered to be withdrawn by the complainant under due identification.
