Heard Mr. Roop Ram Naik, learned counsel, appearing for the petitioners. Also heard Mr. Shailendra Sharma, learned Panel Lawyer, appearing for the respondent No. 1 / State. 2. The petitioners have filed this petition praying for following relief:- “i)To quash/set-aside the charge-sheet/Final Report No.120/2025, F.I.R./Crime No.73/2025 registered at Police Station Kosir, District Sarangarh-Bilaigarh (C.G.) for the alleged offence punishable under Sections 294, 498(A) & 34 of the Indian Penal Code (Annexure P-1). ii) To quash consequential criminal proceeding pending before the learned Judicial Magistrate First Class, Sarangarh, District Sarangarh- Bilaigarh in Criminal Case No.1966/2025 arising out of Crime No.73/2025 (Annexure P-2) 3 registered at Police Station Kosir, District Sarangarh-Bilaigarh (CG). (iii) To pass any appropriate and suitable order in favour of the petitioners, which this Hon'ble court deems fit in the facts and circumstances of the case.” 3. From a perusal of the present CRMP, it is evident from the cause title that the petitioners have failed to implead the husband of the complainant/Respondent No. 2 as a party. Since the dispute appears to be of a familial nature, the husband of Respondent No. 2 is a necessary and proper party to the proceedings. The omission to array him as a party indicates that the petition has been drafted in a vague and sketchy manner, reflecting a casual approach and resulting in the unnecessary consumption of the Court’s valuable time. 4. In view of the same, learned counsel for the petitioners pray to withdraw the present petition with liberty to file afresh. 5. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh, subject to depositing a sum of Rs. 5,000/- as cost by the petitioners in the Registry of this Court and the same shall be transmitted to the Government Multi Handicapped Special School, Bagbahra, District- Mahasamund (C.G.), for wasting the precious time of this Court. 4 6. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same, subject to deposit of the fine amount.
