1. This hearing has been conducted through hybrid mode. 2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’) read with Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as ‘Cr.P.C.’), seeking quashing of FIR No. 148/2019 dated 05.09.2019, registered at Police Station Rajinder Nagar, Central District, Delhi under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom. 3. proceedings through video conferencing and have been duly identified by the Investigating Officer (IO). 5. Briefly stated, the petitioners had sold property bearing No. 29/1, First Floor, Old Rajinder Nagar, New Delhi, by way of two sale deeds dated 31.07.2015 to respondent no. 2 and his late brother, Sanjay Uppal. After the demise of Sanjay Uppal, his undivided share in the property was transferred by his legal heirs in favour of respondent no. 3. Thereafter, respondent nos. 2 and 3 lodged the present FIR on 05.09.2019 alleging, inter alia, prior encumbrance over the said property. Upon completion of investigation in the aforesaid FIR, a charge-sheet was filed and the proceedings are stated to be pending at the stage of framing of charge. 6. During the pendency of the proceedings, the parties entered into a Settlement Deed dated 11.05.2020, whereby respondent nos.
2 and 3 agreed to receive a sum of ₹48,00,000/- towards full and final settlement and to cooperate in the quashing of the FIR and cancellation of the sale deeds. The petitioners state that the entire settlement amount has since been paid, including the balance amount of ₹20,00,000/- pursuant to the order dated 23.12.2020 passed in CS No. 752/2020. Subsequently, vide judgment and decree dated 27.03.2021, the learned Civil Court directed cancellation of the sale deeds, compliance whereof was recorded vide order dated 04.12.2021. 7. On a query made by this Court, respondent No. 2/complainant, who has been duly identified by the IO, has stated that he entered into the Settlement Deed dated 11.05.2020 of his own free will and without any pressure, coercion, undue influence or threat. differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, FIR No. 148/2019 dated 05.09.2019, registered at P.S. Rajinder Nagar, New Delhi under Sections 420/467/468/471/34 of the IPC, and all proceedings arising therefrom are liable to be quashed. 9. Accordingly, FIR No. 148/2019, registered at Police Station Rajinder Nagar, Central District, Delhi under Sections 420, 467, 468, 471 and 34 of IPC along with all consequential proceedings emanating therefrom, is hereby quashed. 10. Accordingly, the present petition is disposed of. 11.
