1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-
“a) Pass a Writ, Order or Direction in the nature of Certiorari or any other appropriate writ, order or direction thereby quashing and setting aside the Impugned Order dated 05.05.2026 issued by the Respondent bank classifying/ reporting the Petitioner as ‘Fraud’ and the Intimation Letter dated 05.05.2026. …”
2. The brief facts of the case are that the petitioner was a Managing Director of IL & FS Tamil Nadu Power Company Ltd. (“ITPCL”) from 24.07.2014 till 10.02.2016. Thereafter, he was a Nominee Director till August, 2017. 3. The petitioner is aggrieved by the declaration of fraud issued by the respondent Bank. 09.02.2026 and more particularly in its paragraph No. 18, it was ordered as under:-
“18. Let the petitioner appear before the review committee at Plot No.04, Sector 10, Dwarka on 09.03.2026 at 11:00 am and the relevant documents shall be supplied to the petitioner within 2 weeks thereafter and the petitioner shall give a response within 4 weeks from date of supply of relevant documents. Thereafter the respondent shall give a date for personal hearing of the petitioner/nominee and after hearing the petitioner, pass a speaking order.”
4. In view of the aforesaid directions of this Court, the petitioner requested for documents vide communication dated 07.03.2026 (Annexure P-11 with the present petition). Thereafter, a hearing was granted to the petitioner and the impugned order was passed on 05.05.2026, wherein the petitioner has been declared a fraud. 5.
At page 14 of the impugned order dated 05.05.2026, it is observed as under:-
“Additionally, as no documents were sought by the party on 09.03.2026 pursuant to the Court order dated 09.02.2026, Shri Seth was afforded an opportunity of personal hearing on 09.03.2026 wherein the committee permitted him to provide supporting documents for his submission denying the allegation levelled in the said cause notice. On perusal of documents submitted by him vide email dated 11.03.2026 and his earlier response This is a digitally signed order. dated 26.08.2025, it is observed that submission made by Shri Seth is not satisfactory with respect to factors of fraud no. 3, 8 & 9 of SCN.”

The observations contained in the impugned order reproduced hereinabove is contrary to the Annexure P-11, which is a communication dated 07.03.2026 wherein the petitioner had duly sought documents. 7. In view of the said glaring inconsistency, the impugned order dated 05.05.2026 is hereby set aside. 8. As per the directions contained in the Order dated 09.02.2026 passed in W.P.(C) 1314/2026, the respondent shall now provide documents available with it and listed in the communication dated 07.03.2026, within 2 weeks from the uploading of the Order. A response to the same shall also be filed within 4 weeks thereafter. Accordingly, the review committee shall afford a hearing to the petitioner afresh and pass a speaking order in accordance with extant rules, regulations and guidelines. 9.
