The accused/applicants have moved this first bail application under Section 483 of BNSS, 2023 for releasing them on regular bail during trial in connection with Crime No. 504/2025 registered at Police Station – City Kotwali HEERA LAL SAHU Digitally signed by HEERA LAL SAHU Date: 2026.02.28 16:39:40 +0530 2 Durg, District – Durg (C.G.) for the offence punishable under Sections 296, 351(3), 115(2), 117(2), 103(1) read with Section 3(5) of BNS Sections 25 & 27 of Arms Act. 2. In this case, a total of 6 accused persons, including two juvenile accused, are involved. As per the prosecution’s case, on 18.10.2025, the complainant, Nihal Patel, made a complaint against the accused persons stating that on 17.10.2025 at about 6:30 pm, some persons had celebrating the marriage function, at that time the accused persons came there and assaulted Neeraj Thakur (now deceased) and Suraj Thakur and also abused them by using filthy language. The accused persons also assaulted Neeraj by means of a wooden stick, rod and sharp-edged knife, due to which Neeraj sustained grievous injuries and died during treatment. Based on this, offence has been registered against the present applicants and other juvenile co-accused persons. 3. Learned counsel for the applicants submits that the applicants have been falsely implicated in the present case as there is no motive to cause murder. He further submits that complainant Nihal Patel was not present at the spot and there is no independent witness in the case. The applicants are in jail since 18.10.2025, and there is no likelihood of their case being decided in the near future; therefore, the present applicants may be released on bail. 4. On the other hand, learned counsel for the State opposes the bail application and submits that the applicants along with two other juvenile co-accused, have committed the alleged assault on the deceased by means of a wooden stick, rod and a knife, due to which the deceased sustained multiple injuries and died during treatment. The names of the applicants have been mentioned in the FIR, and as per 3 the memorandum statements of the applicants, there are seizure of the alleged weapons. There are 5 eyewitnesses in this case. The trial has not commenced yet and there are sufficient material against the present applicants; therefore, at this stage, they are not to be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the entire facts and circumstances of the case, particularly looking to the material available on record, the evidence collected by the prosecution against the applicants, the gravity of the offence and also considering the fact that the trial has not commenced yet, at this stage, without commenting on merits of the case, I am not inclined to release the applicants on bail. Accordingly, the bail application filed under Section 483 of BNSS, 2023, is rejected. 7.
