This bail application has been filed on behalf of Shabnam Khatoon who is in custody since 31.10.2025 in connection with Birni P.S. Case No. 165 of 2025 for the offence registered under Section 80 of the BNS, but S.P. Giridih have found a prima case under Section 80 and 3(5) of the BNS, 2023 pending in the Court of CJM, Giridih, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that petitioner is the sister-in-law of deceased and therefore, there cannot be any credence to the allegation of dowry demand against her. There is a general allegation of making such demand against the entire family (six in number). It is further submitted that allegedly this petitioner was having illicit relationship with the husband of the deceased which is not sufficient to make out the offence under Section 80 of BNS. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
