912 CRA NO. 191 OF 2026.odt IN THE HIGH COURT OF JUDICATURE OF BOMBAY BENCH AT AURANGABAD 912 CRA NO. 191 OF 2026 Bhagwan Sudhakar Vedpathak VERSUS Indumati Madhavrao Puri ... Mr. Vasmatkar Amol G, Advocate for the Applicant ….
CORAM : SANJAY A. DESHMUKH, J.
DATE : 07.10.2026 PER COURT :-
1. Heard learned Advocate for the Applicant. He pointed out the impugned order and the grounds raised in the Application seeking rejection of the plaint. He submitted that the suit filed by the plaintiff is barred under Sections 36-A and 36-B of the Maharashtra Prevention of Fragmentation and Consolidation Act, as the area of the suit property was reduced during the consolidation scheme and the Trial Court has no jurisdiction to decide any claim relating to the consolidation scheme.
2. However, in paragraph No.9 of the impugned order, the learned Trial Court has observed that the suit has been filed for declaration and possession of the suit property and, therefore, the grounds raised in the application seeking rejection of the plaint 1 of 2
(( 2 )) 912 CRA NO. 191 OF 2026 cannot be considered at this stage. The suit contains multiple prayers, including the reliefs of declaration and possession. The learned Trial Court has, therefore, rightly rejected the application filed by the Applicant, as there is no substance in the objections raised therein. No interference with the impugned order is warranted. Accordingly, the Civil Revision Application is rejected.
