1. The present petition has been filed under Articles 226 and 227 of the Constitution of India, inter alia, seeking the following relief :
“ i Direct the Respondent Bank to accept the balance 75% amount of the 1st auction dated 22.08.2019 and consequently issue the Sale Certificate and hand over possession of the subject auctioned properties to the Petitioner upon receipt of the balance Sale consideration amount; ii In the alternative, direct the Respondent No.1 Bank to forthwith refund the deposited/forfeited 25% of the EMD/Sale
consideration amount along with interest accrued thereon from the date of deposit till the date of actual payment; iii In the alternative, Direct the Ld. Debts Recovery Appellate Tribunal to expeditiously dispose of the Regular Appeal No. 213/2023 in a time-bound manner; This is a digitally signed order. iv Pass any other or further order as this Hon’ble Court may deem fit and proper in the

Learned counsel appearing for the petitioner submits that the petitioner had already moved an application dated 06.05.2026 before the learned Debt Recovery Appellate Tribunal (DRAT) seeking early hearing of the aforesaid appeal. It is submitted that the said application has not yet been taken up for consideration. Learned counsel further submits that the matter is presently listed before the learned DRAT on
24.09.2026.

In view of the aforesaid submission, we request the learned DRAT to consider the application for early hearing filed by the petitioner on the next date of hearing, i.e., 24.09.2026, and, after hearing the parties, pass an appropriate order thereon in accordance with law, keeping in view the urgency, if any, pleaded by the petitioner.
4. With the aforesaid observations and direction, the present petition, along with the pending application(s), stands disposed of.
