(In A.B.A.-1582/26) ----- 05/22.06.2026 Both these A.B.As. are arising out of same FIR and in view of that, these A.B.As. have been heard together. 2. Heard learned counsel appearing for the petitioners and learned counsel appearing for the State in respective cases. 3. The petitioners are apprehending their arrest in connection with Harla P.S. Case No.159/2025 dated 12.10.2025, registered for the offence under Section 80 of the BNS, pending in the Court of the learned Chief Judicial Magistrate, Bokaro. 4. Learned counsel appearing for the petitioners submits that in A.B.A. No.1497 of 2026, the petitioners are brother-in-law and mother-in-law respectively of the deceased and in A.B.A. No.1582 of 2026, the petitioner is husband of the deceased. He further submits that there are general and omnibus allegations of torture and demand of dowry and subsequently the ( 2026:JHHC:18067 ) -2- A.B.A. No. 1497 of 2026 With A.B.A. No. 1582 of 2026 deceased has committed suicide in her parents’ house. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioners. 5. Learned counsel appearing for the State in the respective cases opposed the prayer and submit that there are allegations against the petitioners of demand of dowry and torture and in view of that, the prayer for anticipatory bail may kindly be rejected. 6. In the FIR, it is alleged that the husband of the deceased used to torture her and even used unparliamentary words against her and has also sent inappropriate messages and the witnesses have supported the case of prosecution in paras 3, 5, 11, 14 and 15 of the case diary and considering that there is direct allegation against the husband and in the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner in A.B.A. No.1582 of 2026, namely, Mukesh Kumar Das and, as such, his prayer for anticipatory bail is, hereby, rejected. 7. So far as petitioners in A.B.A. No.1497 of 2026 are concerned, they are brother-in-law and mother-in-law respectively of the deceased and there is general and omnibus allegation against them. It also transpires that there is no direct allegation against them and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners in A.B.A. No.1497 of 2026. 8. Accordingly, the petitioners in A.B.A. No.1497 of 2026, namely, Ajay Kumar Das and Palo Devi are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the ( 2026:JHHC:18067 ) -3- A.B.A. No. 1497 of 2026 With A.B.A. No. 1582 of 2026 satisfaction of learned Chief Judicial Magistrate, Bokaro in connection with Harla P.S. Case No.159/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 9.
