Ajmer Vidyut Vitaran Nigam Limited, Through Its Managing Director, Vidyut Bhawan, Panchsheel Nagar, Makadwali Road, Ajmer 305004 2. Assistant Engineer (O And M), Ajmer Vidyut Vitaran Nigam Limited, Udaipurwati, Distt. Jhunjhunu (Raj.) ----Appellants Versus Ramnath Saini S/o Sh. Mali Ram Saini, R/o Rawata Ki Dhani (Ward No.2), Nawalgarh, Distt. Jhunjhunu (Raj.) ----Respondent For Appellant(s) : Mr. Virendra Lodha, Senior Counsel assisted by Mr. Rachit Sharma. For Respondent(s) : Mr. Ajay Gupta. HON'BLE MR. JUSTICE INDERJEET SINGH HON'BLE MR. JUSTICE RAVI CHIRANIA Order 06/01/2026 1. This appeal has been filed by the appellants challenging the order dated 30.11.2018 passed by the learned Single Judge of this Court whereby the writ petition filed on behalf of the respondent- petitioner was allowed. 2. The learned Single Judge while allowing the writ petition observed as under:- “9. It is noticed that the said judgment was complied with and the petitioners therein were all granted benefit of pay scale. Since the question relating to the petitioner’s services was an issue before [2026:RJ-JP:125-DB] (2 of 3) [SAW-614/2019] this Court in separate proceedings (supra) and ultimately an order was passed setting aside his reversion, granting him consequential benefits, it was incumbent upon the respondents to have fixed him in the same pay scale as the other Meter Readers who have appointed prior to 1979. Accordingly, the action of the respondents in fixing the petitioner in pay scale No.2 instead of pay scale No.3 is held to be unjustified. 10. With the aforesaid observations, the writ petition stands allowed. The petitioner would be entitled for his revision of pay scale in terms of pay scale No.3 w.e.f. his date of appointment i.e. 01.04.1968. It goes without saying that the petitioner shall alsobe entitled for his revised pay scales from time to time. Accordingly, he would be also entitled for grant of revision of selection scales in terms of the circular issued by the State Government from time to time. As the petitioner has already retired, his retiral benefits shall also be re-fixed and pension shall also be re-fixed. Apart from retiral dues and arrears on account of the aforesaid, arrears of re-fixations shall also be released to the petitioner accordingly. The entire exercise shall be conducted within a period of three months henceforth. 11. Taking into consideration the long litigation going on and petitioner having been raising his claims even prior to his retirement, interest on the aforesaid arrears is fixed @ 6% per annum which shall be paid to the petitioner within the aforesaid period. It also goes without saying that if the compliance is not made within the said period, the petitioner shall be free to initiate contempt proceedings.” 3. We have gone through the order passed by the learned Single Judge and are in complete agreement with the view taken by the learned Single Judge, therefore, no case is made out for [2026:RJ-JP:125-DB] (3 of 3) [SAW-614/2019] interference by this Court in the order passed by the learned Single Judge. 4. In that view of the matter, this appeal is accordingly dismissed. (RAVI CHIRANIA),J (INDERJEET SINGH),J MG/47
