Instant writ petition under Article 226 of the constitution of India has been preferred by the petitioner seeking following reliefs :- 10.1 The Hon’ble Court may kindly be pleased to call for the records of the instant case. 10.2 That, this Hon’ble Court may kindly be pleased order any appropriate Writ / Writ (s), Direction/Direction(s) to the Respondent No. 3 to take appropriate decision in the case no. 202505280100016/A-59/2024-2025 pending before the Respondent No. 3 within a stipulated period of 30 days in the interest of justice. 10.3 That, this Hon’ble Court may kindly be pleased order any appropriate Writ Writ(s), Direction / Direction (s) to the Respondenet authorities not to acquire the land of the Petitioners till the final decision is taken by the Respondent No. 3 with respect to allotment of land to the Petition in exchange in the interest of justice. 10.4 That, the Hon’ble Court may kindly be pleased order any appropriate Writ / Writ(s), Direction/ Direction(s) to the Respondent No. 3 not to allot the land in the Khasra No. 2370/1 Tehsil Pendra til the final adjudication of the case of the Petitioners. 10.5. The Hon’ble Court may kindly be pleased to grant any other Relief/Relief(s),Direction/ Direction(s) in favour of the Petitioner as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case. 10.6 Award cost of proceedings in favour of the Petitioner. 2. Learned counsel appearing for the petitioners submits that the steps have been taken by respondents/ State authorities for acquisition of the petitioner’s land bearing Khasra No. 2955/2, admeasuring 0.0360 hectare situated at Tehsail 3 Pendra, District Gourela-Pendra-Marwahi for the public project namely ‘Arap Udgam Vikas and Jal Kund”. The respondent authorities have also initiated proceedings bearing case no. 202505280100016/A-59/2024-2025 for exchange / allotment of part of Khasra No. 2370/1 as an alternative land to the petitioner. Aforesaid case is pending consideration before respondent No. 3-Collector, District Gourela-Pendra- Marwahi, therefore, learned counsel for the petitioner, at this stage, submits that this petition may be disposed of directing respondent No. 3- Collector, District Gourela- Pendra-Marwahi to decide the aforesaid case within a specific time frame. 3. Learned counsel for the State would submit that the afoersaid case in under consideration and the same shall be decided in accordance with law. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Having considered aforesaid facts and contention putforth by learned counsel for the parties; particularly considering to limited prayer made by counsel for the petitioner, instead of keeping instant petition pending, at this stage, the same is disposed of directing respondent No. 3- Collector, District Gourela-Pendra-Marwahi to decide the case no. 202505280100016/A-59/2024-2025 expeditiously preferably within a period of 30 days from the date of receipt / submission of copy of this order. 6. With the aforesaid observations & directions, this petition stands disposed of. 7. Pending interlocutory application (s), if any, stand (s) disposed of.
