- 1 - criappeal700.26.odt IN THE HIGH COURT OF JUDICATURE OF BOMBAY BENCH AT AURANGABAD 936 CRIMINAL APPEAL NO. 700 OF 2026 Gaurav Sakharam Mule ….Appellant VERSUS The State of Maharashtra & another …..Respondents Mr. S. J. Salunke, Advocate for Appellant Mr. S. B. Narwade, APP for the State. Mr. P. V. Giri, Advocate (appointed) for the informant. CORAM : R. M. JOSHI, J. DATE : 8th OCTOBER, 2026. PER COURT : 1. Learned APP submits that during the pendency of the appeal, charge-sheet has been filed. He, therefore, contends that it would be required for the Appellant to move the Special Judge to seek bail in view of change in circumstances. 2. Learned Counsel for the Appellant though does not dispute the fact with regard to filing of charge-sheet, however, it is his contention that the experience which the Appellant had while deciding previous bail application before Special Judge is that all attempts are made on behalf of the informant to delay hearing of the bail application. He - 2 - criappeal700.26.odt drew attention of the Court to the similar attempts being made by the informant in this Court too. 3. This Court finds substance in the contention of learned Counsel for the Appellant that informant makes all endeavours to ensure that appeal is not heard. However, in the facts of the case, the only relief which can be granted to Appellant is that the Trial Court is directed to decide the application for bail by the Appellant within period of a week from its filing. Such directions are necessary in view of the attempts made by informant to delay the hearing of bail application. 4. In view of above, appeal stands disposed of. 5. Fees of the appointed counsel is quantified at Rs. 10,000/-. ( R. M. JOSHI, J.) dyb
