1. This hearing has been done through hybrid mode. 2. The present petition has been filed by the Petitioners under Article 226 of the Constitution of India, inter alia, seeking directions to the Registrar of Co-operative Societies (hereinafter, ‘RCS’) to decide the Petitioner’s representation dated 3rd July, 2025 in a time-bound manner. 3. The background of Petitioner’s case is that, Petitioners are stated to be the occupants of Flat No.49 in the Evergreen Co-operative Group Housing Society Ltd., Plot No.09, Sector-07, Dwarka, New Delhi, (hereinafter, ‘Society’). 4. The Petitioners claim to have purchased Flat No. 49 in the Society on 30th March, 2017. In this regard, reliance is placed upon various title documents, including the sale deed, etc., which has been placed on record. 5. They had filed a representation dated 3rd July, 2025 under Section 91 of the Delhi Co-operative Societies Act, 2003 (hereinafter ‘Act’) before the Society, seeking grant of membership and transfer of shares in favour of the Petitioners. However, the grievance of the Petitioners is that the said representation has not been decided till date. 6. Issue notice. Ms. Harshita Nathrani, ld. Counsel for the RCS accepts notice. 7. The Court has considered the matter. The only prayer is for grant of membership and transfer of shares. The representation was filed by the Petitioners way back on 3rd July, 2025 under Section 91 of the Act, which stipulates a period of 30 days from the submission of application, for grant of membership.
Clearly there has been a delay on the part of the RCS and accordingly the following directions are issued: (i) The Petitioners shall appear before the RCS on 15th September, 2026 at 11:30 AM along with all the relevant documents. On the said date, the Secretary or any other office bearer of the society shall also produce the relevant records before the RCS. (ii) After considering the records, and the representation made by the Petitioners, the grant of membership and transfer of shares shall be processed by the RCS, subject to the documents being in order. (iii) The entire process shall be completed by 15th October, 2026. This is a digitally signed order.
