R K AGARWALA Advocate for : GA ASSAM appearing for THE STATE LEVEL COMMITTEE AND 2 ORS. BEFORE HONOURABLE MR. JUSTICE KARDAK ETE ORDER Date : 07.01.2026
Heard Mr. R. K. Agarwala, learned counsel for the applicants. This is an application praying for impleadment of the opposite party Nos. 1, 2 & 3, namely, the State Level Committee; North East Development Finance Corporation (NEDFi); and the Director, Ministry of Commerce and Industries, Department of Promotion of Industry and Internal Trade of Government of India, as respondent Nos. 5, 6 & 7, respectively, in the connected writ petition, being WP(C) No. 5078/2021, on the ground that the parties sought to be impleaded are the disbursing authorities under the Transport Subsidy Scheme,
1971. Page No.# 3/4
The applicants have filed the connected writ petition seeking transport subsidy under the Transport Subsidy Scheme, 1971, being the manufacturer of ALUM (Ferric and Non-Ferric), which is required for industrial uses like water treatment plants, manufacturing of papers and other industrial uses. Mr.
R. K. Agarwala, learned counsel for the applicants, submits that inadvertently the State Level Committee; North East Development Finance Corporation (NEDFi); and the Director, Ministry of Commerce and Industries, Department of Promotion of Industry and Internal Trade of Government of India, have not been arrayed as party respondents in the connected writ petition, though the respondents sought to be impleaded are the necessary parties, being the disbursing authorites under the Transport Subsidy Scheme, 1971, and therefore, they are required to be impleaded for proper adjudication of the connected writ petition. Having considered the submission of learned counsel for the applicants and also taking note that the opposite parties sought to be impleaded are the disbursing authority under the Transport Subsidy Scheme, 1971, under which the applicants/ petitioners are claiming subsidy in the connected writ petition, which is pending consideration before this Court, I am of the considered view that the opposite parties appears to be the necessary parties for proper adjudication of the matter. Thus, I deem it appropriate to allow this interlocutory application. Accordingly, the State Level Committee; North East Development Finance Corporation (NEDFi); and the Director, Ministry of Commerce and Industries,
Page No.# 4/4 Department of Promotion of Industry and Internal Trade of Government of India, are allowed to be impleaded as respondent Nos. 5, 6 & 7, respectively, in the connected writ petition, being WP(C) No. 5078/2021. The interlocutory application stands disposed of. JUDGE Comparing Assistant
