1. The present appeals arise out of proceedings initiated under Section 9 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the
“Act”).
2. During the pendency of the present appeals, arbitration was invoked and petitions under Section 11(6) of the Act, being ARB.P. Nos. 145/2026 and 146/2026, were filed before this Court. The said petitions were allowed vide
order dated 02.07.2026 and the Arbitral Tribunal has since been constituted.
3. Vide the impugned orders, the learned District Court had granted interim protection against respondent no.1, which was thereafter not continued. On the last date of hearing, learned counsel for respondent no.1 had stated that respondent no.1 undertakes to comply with the directions passed by the learned District Court on 17.10.2025, till the Arbitral Tribunal is constituted. Today, it is informed that an application filed under Section 17 of the Act is now coming up for consideration on 08.09.2026 before the learned Arbitrator.
4. The aforesaid undertaking shall continue till 08.09.2026, whereafter the parties shall be at liberty to seek continuation, vacation or modification of the interim protection before the learned Arbitrator. In view thereof, the present appeals, along with the pending applications, are disposed of. It is clarified that This is a digitally signed order.
