The petitioners are apprehending their arrest in connection with Dhanwar (Ghorthamba O.P.) P.S. Case No. 140 of 2025, registered for the offence under Sections 191(2), 190, 115(2), 117(2), 118(1), 109, 76, 303(2), 352 and 351(2) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, First Class, Giridih. 3. Learned counsel appearing for the petitioners submits that there are case and counter case between the parties and the altercation took place due to the land dispute. He submits that in the case lodged by the petitioners’ side, the accused persons have been granted anticipatory bail by this court in A.B.A. No.6541 of 2025 and A.B.A. No.7159 of 2025. He next submits that the entire family members have been made accused in the present case. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegation of assault are there. 5. Considering that there are case and counter case between the parties and the scuffle took place due to plucking of mango and both the sides have received injury and in the case lodged by the petitioners’ side, the accused persons have been granted anticipatory bail by this court in the aforesaid A.B.As., in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioners. 2026:JHHC:18301 6. Accordingly, the above-named petitioners are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, First Class, Giridih, in connection with Dhanwar (Ghorthamba O.P.) P.S. Case No. 140 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
