The present petition was filed seeking a direction to open and finalise the financial bid of the petitioner in respect of Package No. ASOM MALA 3.0_25_26_48 at Serial No. 1 of the DNIT dated 17.10.2025, pertaining to the work of Improvement and Upgradation of road from (i) Jaijabari Chowk to Barbila from Ch. 0.00 km (Jaijabari Chowk) to Ch. 13.17 km (Allia) and (ii) Bhuyarkuchi to BTD from Ch.0.00 (Bhuyarkuchi) to Ch. 7.00 km (Hahdali) under ASOM Mala 3.0 for the year 2025–26, in terms of the DNIT dated 17.10.2025. Md. S. Hoque, learned counsel for the petitioner, submits that the writ petition has become infructuous inasmuch as, during the pendency of the present writ petition, the respondent authorities have opened the financial bid, wherein the petitioner has been found to be L-1. Having considered that during the pendency of the writ petition, the financial bid has already been opened and the petitioner has been found to be L-1, no further cause survives for adjudication. Accordingly, the writ petition stands closed on having been become infructuous. It is needless to observed that the respondent authorities shall be at liberty to finalise the tender in accordance with law. JUDGE Comparing Assistant
