3. By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), the petitioners seek quashing of FIR No. 663/2021, registered at Police Station Vasant Kunj South, New Delhi, under Sections 498A/406/354/323/506 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), along with all consequential proceedings arising therefrom, on the basis of an amicable This is a digitally signed order. settlement arrived at between the parties.
4. Issue Notice. Learned APP for the state accepts notice on behalf of the state.
5. The petitioners and Respondent No. 2 are present before this Court and have been duly identified by the Investigating Officer concerned. Respondent No. 2 is present through video conferencing along with her mother, who is her duly constituted Special Power of Attorney holder.
6. The brief facts of the case are that the marriage between Petitioner No. 1 and Respondent No. 2 was solemnized on 31.08.2020 at Arya Samaj Mandir, Rajender Market, Tis Hazari, Delhi, in accordance with Hindu rites, customs and ceremonies. No child was born out of the said wedlock. Owing to matrimonial discord and temperamental differences, disputes arose between the parties, resulting in the registration of FIR No. 663/2021 dated 27.12.2021 at Police Station Vasant Kunj South, New Delhi, under Sections 498A/406/354/323/506 of the IPC. The parties subsequently amicably resolved their disputes and entered into a Settlement Agreement dated 24.04.2026 before the Delhi Mediation Centre, Patiala House Courts, New Delhi. In terms of the settlement, the parties agreed to dissolve their marriage by mutual consent and bring all pending litigations arising out of their matrimonial relationship to an end. The marriage between Petitioner No. 1 and Respondent No. 2 has since been dissolved by a decree of divorce by mutual consent dated 07.08.2026 passed by the learned Principal Judge, Family Court, New Delhi District, Patiala House Courts, New Delhi.
7.
Learned counsel for the petitioners submits that, in terms of the Settlement Agreement dated 24.04.2026, the parties agreed to settle all their disputes for a total sum of Rs.30,00,000/- (Rupees Thirty Lakhs Only). submits that a sum of Rs.10,00,000/- each has already been paid to Respondent No. 2 at the time of recording of statements in the First Motion and Second Motion proceedings and that the balance amount of Rs.10,00,000/- has also already been paid to Respondent No. 2. It is further submitted that the entire settlement amount of Rs.30,00,000/- has been paid and that the terms and conditions of the settlement stand fully complied with. Nothing further remains to be paid by either party under the settlement. 8. On a query made by this Court, Respondent No.2, who has been duly identified by the IO, categorically states that she has entered into the settlement out of her own free will, without any force, coercion or undue influence. She further states that the entire settled amount has been received by her and that she has no surviving claim whatsoever against the Petitioners. She has no objection if the present FIR and all proceedings emanating therefrom are quashed. 9. In view of the fact that the parties have amicably resolved all their disputes, their marriage already stands dissolved by a decree of divorce by mutual consent, the entire settlement amount has been paid, and Respondent No. 2 has no objection to the quashing of the FIR, no useful purpose would be served in continuing the criminal proceedings. Rather, continuation thereof would only perpetuate unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case. 10. Accordingly, FIR No. 663/2021, registered at Police Station Vasant Kunj South, New Delhi, for the offences punishable under Sections 498A/406/354/323/506 of the IPC, and all consequential proceedings emanating therefrom, are hereby quashed.
