The revisional application being CO 3167 of 2025 has been preferred by the wife/petitioner praying for transfer of Act VIII Misc Case No. 124 of 2025 corresponding to Online CIS No. Act VIII Misc Case No. 22 of 2025, from the Court of learned 3rd Fast Track Court, Barrackpore, North 24 Parganas to the Court of learned District Judge, Paschim Medinipur. 2. The revisional application being CO 2031 of 2025 has been preferred by the husband/petitioner praying for transfer of Act VIII Case No. 45 of 2024 (R-46 of 2024), from the Court of learned District Judge, Paschim Medinipur to the Court of learned Additional District Judge, Barrackpore. 3. The revisional application being CO 3915 of 2024 has been preferred by the wife/petitioner praying for transfer of Mat Suit No. 561 of 2024, from the Court of learned 3rd Fast Track Court, Barrackpore, North 24 3 3 Parganas to the Court of learned District Judge, Paschim Medinipur. 4. It appears that the wife herein is posted as a Branch Manager of State Bank of India, at Paschim Medinipur and the husband herein is a Government Doctor presently posted at Cooch Behar. 5. It appears that both parties have their permanent address at Kolkata. 6. The Supreme Court in N.C.V. Aishwarya vs A.S. Saravana Karthik Sha, in Civil Appeal No(s). 4894 of 2022 (arising out of SLP (C) No(s). 16465 of 2021), decided on July 18, 2022, (Para 11, 12), has decided the issue of transfer in such cases. 7. The following Judgments are relied upon by the husband:- i. Usha George vs Koshy George, (2000) 10 SCC 95. ii. Gayatri Mohapatra vs Ashit Kumar Panda, (2003) 11 SCC 731. iii. Anindita Das vs Srijit Das, (2006) 9 SCC 197. iv. Abhilasha Gupta vs Harimohan Gupta, (2021) 9 SCC 730. 4 4 8. Considering the fact that the both parties herein are employed, one at Paschim Medinipur and the other at Cooch Behar and both parties having residence at Kolkata and the proceedings in CO 3167 of 2025, Act VIII Misc Case No. 124 of 2025 corresponding to Online CIS No. Act VIII Misc Case No. 22 of 2025, be transferred from the Court of learned 3rd Fast Track Court, Barrackpore, North 24 Parganas to the Court of learned Additional District Judge, Sealdah, keeping in mind the convenience of both parties. 9. The proceedings in CO 2031 of 2025, Act VIII 45 of 2024 be transferred from the Court of learned District Judge, Paschim Medinipur to the Court of learned Additional District Judge, Sealdah. 10. The proceedings in CO 3915 of 2024, Mat Suit No. 561 of 2024, be transferred from the Court of learned 3rd Fast Track Court, Barrackpore, North 24 Parganas to the Court of learned Additional District Judge, Sealdah. 11. Learned Additional District Judge, Sealdah shall proceed with the said 5 5 cases (3) in accordance with law with due notice upon both the parties. 12. Keeping in mind the case of the parties herein, the learned Additional District Judge shall be at liberty to permit the parties to appear virtually, if parties make such prayer. 13. CO 3167 of 2025, CO 2031 of 2025 and CO 3915 of 2024 are disposed of. 14. Parties to act on the server copy of this order. 15.
