The grievance of the petitioner herein is that the Respondent Authorities have not permitted the petitioner to join and as such, the present writ petition has been filed. 4. It is seen that when the writ petition was first moved before this Court, this Court directed the State respondents to obtain instructions and apprise this Court on the next date, as to why, the petitioner had not been permitted to join. In pursuance thereto, the matter has been listed today. 5. Mr. T.C. Chutia, the learned Additional Senior Government Advocate has placed before this Court an instruction issued by the Senior Superintendent of Police Nalbari, Assam dated
06.01.2026. The said instruction dated 06.01.2026 is accompanied by various other documents which are collectively kept on record and marked with the letter “X”.
In terms with the said instructions, it is seen that upon carrying out the police verification of the petitioner in respect to her character and antecedents, it came into light that the petitioner is involved in a criminal case registered as Belsor P.S. Case No. 01/2025 under Section 376/384/325/354/34 of the Indian Penal Code which has been charge-sheeted vide Charge Sheet No. 15/2024 dated

The instructions further show that the petitioner has not been able to furnish the required affidavit with self declaration regarding non-involvement in any criminal case and as such the petitioner’s joining process could not be completed. It is further mentioned that the petitioner has also been informed verbally. 6. The learned counsel appearing on behalf of the petitioner submitted that taking into account the said instruction which is kept on record and marked with the letter “X”, the petitioner would not like to press the instant writ petition. However, it is submitted that in the circumstance, the criminal proceeding against the petitioner is quashed or the petitioner is acquitted, the withdrawal of the instant writ petition should not prejudice the petitioner. 7. Taking into account the above, the instant writ petition therefore stands closed on withdrawal. 8. It is further observed, that in the circumstance the criminal proceeding against the petitioner is quashed or the petitioner is acquitted the withdrawal of the instant writ petition shall not prejudice the petitioner.
