JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court, seeking the following prayer: "In Crl.P.No.16020/2025: Wherefore the petitioner humbly pray that this Hon'ble court may be pleased to quash the FIR in Crime No.32/2021 (C.C.No.22835/2021) against the petitioner, who is arrayed as accused No.1, on the complaint of 2nd Respondent Police/ Basavanagudi Women Police Station, West Zone, Bengaluru City, for an offence under Section 498A of IPC R/W Section 3 and 4 of D.P. Act, which is now pending on the file of 32th Additional CMM, Bengaluru City, and pass such other orders as this Hon'ble court deems fit, in the interest of justice. Heard Sri. Jairaj G., learned counsel appearing for the petitioners, Sri. K. Nageshwarappa, learned HCGP appearing for respondent No.1, Sri. Gopal, learned counsel appearing for respondent No.2 in both the cases and have perused the materials on record. 3. The parties to the lis were also before the Family Court in M.C.No.140/2024 and have settled the dispute amongst themselves before the Family Court by terms of settlement. One of the term of the settlement is, closure of the present proceedings. The said term in the settlement reads as follows: "3. The petitioner has agreed to pay a sum of Rs.5,00,000/-(Rupees Five Lakhs Only) to the respondent towards all her claims of maintenance/ permanent alimony in full and final settlement towards all claims thereof and the respondent has agreed to the same. In respect of the above the petitioner shall pay a sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand Only) by way of cash and respondent agrees to the same. The remaining balance amount of Rs.2,50,000/-(Rupees Two Lakhs Fifty Thousand Only) shall be paid by way of demand draft bearing No.006178 dated: 10.07.2024 drawn on HDFC Bank, Bannerghatta Branch, Bengaluru and same will be handed over to the respondent at the time of reporting the settlement before this Hon'ble Court. 8. The petitioner's parent's have filed the criminal petition to of Karnataka in before the Hon'ble High Court Cri.P.No.5549/2022 against the respondent for quashing - 7 - HC-KAR NC: 2026:KHC:7087 CRL.P No. 16020 of 2025 C/W CRL.P No. 5549 of 2022 the proceedings in the above mentioned C.C.No.22835/2021 before the 37th ACMM., Bengaluru. In view of the amicable settlement between the petitioner and the respondent herein, the petitioner and the respondent have mutually decided to take necessary steps before the Hon'ble High Court of Karnataka, Bengaluru for closure of said case in accordance with law. With respect to the above petition Crl.P.No.5549/2022, the respondent has agreed to extend co-operation and support to the petitioner and his family members mentioned above. As the respondent is currently employed in UK, she is unable to be physically present before this Hon'ble Court and Hon'ble High Court of Karnataka. The Respondent undertakes to appear virtually before this Hon'ble Court and Hon'ble High Court of Karantaka and confirm the terms of this settlement to ensure amicable closure of the Cri.P.No.5549/2022 aforesaid. The respondent also agrees to execute a general power of attorney in favor of her brother Sri.S.Vinod or any other family member to appear before the concerned Courts and sign on her behalf and also to report the terms of this settlement." 4. Therefore, in light of the settlement arrived at between the parties quoted supra and the offences not being against the State, I deem it appropriate to terminate the proceedings pending against these petitioners in the subject petitions. 5.
