The Court made the following Order:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents. 2. This writ petition is filed questioning the action of the 3rd respondent in interfering with the peaceful possession and enjoyment of the house site of the petitioner situated in Sy No.581 of Machavaram Village, Kanigiri Mandal, Prakasam District. 3. On the other hand, the learned Assistant Government Pleader appearing for the respondents relying upon the written instructions of the 3rd respondent dated 26.04.2026 submits that as per the verification of the records in the office of the 3rd respondent the file F.Dis.No.856/2010, dated 25.12.2010 was not traced and there is no D.K Register and beneficiaries list in the office, hence prima facie the patta produced by the petitioner is rank one forged document and the petitioner was never issued any house site pattas as alleged. The subject land in Machavarma Village and other assigned lands in the Mandal were alienated by the original assignees in contravention of the A.P. Assignment (POT) Act. The predecessor has issued Form-1 and 2 Notices under A.P. Assignment (POT) Act and Rules to the legal heirs of the original assignee Podili Mastan Saheb and the persons who purchased the assigned lands vide Rc.DT/214/2021, dated 05.08.2021 to one Shaik Shabbir S/o Balaram (Form-I) and Shaik Abdul Khadar Sha Vali (Form-II), Shaik Hamja Saheb S/o Shaik Mahaboob Peera (Form-I) and Dadala Narayana S/o

Malakondaiah (Form-II) directing them to submit their explanation as to why the assignment shall not be resumed in favor of the Government for violation of condition of grant. Later, the predecessor of the 3rd respondent submitted his report to the then Sub-Collector, Kandukur vide Rc.DT/214/2021, dt.06.08.2021.
After Formation of new Revenue Division at Kanigiri, the Revenue Divisional Officer, Kanigiri submitted his report to the Joint Collector & Additional District Magistrate, Prakasam District, Ongole vide Rc.DT/214/2021 dt.30.07.2024 and 02.08.2024 submitting proposals for change of details of the said lands including the subject land as Government land as per the CCLA’s Ref.No.LR-I/ROR/551/2022, dt.12.10.2022. As per the report of the Revenue Divisional Officer, Kanigiri, the joint Collector & Additional District Magistrate, Prakasam District, Ongole passed proceedings vide Rc.L6/480/2024, dt.21.08.2024 by ordering to enable the Suo-Motu option in Joint Collector’s Web Land login for the list of lands including the subject land in Sy.No.581 of Sankavaram resumed and directed to implement the resumption proceedings in Tahsildar’s Webland login as per the Act and Rules in force. As per the directions of the Joint Collector & Additional District Magistrate, Prakasam District, Ongole the said lands are recorded as Government lands. None of the effected persons preferred any appeal or revision against the orders of the Joint Collector, Prakasam District, hence the orders became final. With respect to the same Sy.No.581 of Machavaram Village and the W.P.Nos. 10827 and 9048 of 2026 are filed before this Court. 5 BKM,J W.P.No.11361 of 2026

In view of the above said facts and circumstances and upon recording the written instructions of the 3rd respondent dated 26.04.2026, since the subject land was already resumed to the Government by the above said proceedings to the respondent authorities are concerned, it is open for the petitioner, if so aggrieved and if so advised, to assail the said resumption proceedings in accordance with law, if not already done. The petitioner is at liberty to approach the authority concerned for securing the resumption proceedings in respect of the subject land. 5. Accordingly, this writ petition is disposed of. The Interim order, if any, deemed to have been vacated. There shall be no order as to costs. The written instructions of the 3rd respondent, dated 26.04.2026 shall be made as part of the Court record.
