In the prayer, petitioner has challenged only the notice issued by the Circle Officer, Chainpur, Palamau in Miscellaneous Case No.1122 of 2016, whereby the petitioner has been directed to remove the Encroachment over the land having Khata No.235, Plot No.1343/D, Area 13.6 acres. 3. Since, the notice has been challenged this Court is not inclined to interfere with the same. The petitioner, so adviced may appear before the Officer concerned and submits his defence which will be considered and only after considering the same and an appropriate order will be passed by the respondents, as per law. 4. It is expected that the petitioner should file his defence within four weeks from today, which is expected to be decided within a period of eight weeks thereafter. 5. If the petitioner does not appear and file his defence, the Circle Officer, Chainpur, Palamau will proceed to pass an appropriate order as per law on merit. 6.
