Order No.02 Dated-22-06-2026
Heard the parties.
The petitioner has been made accused in connection with Patratu (Bhurkunda) P.S. Case No.264 of 2025 registered for the offence punishable under Sections 126(2), 115(2), 308(3), 140, 3(5) of the B.N.S., 2023.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner abducted the informant namely Vikash Kumar Singh, looted Rs.10,000/- and demanded ransom of Rs.3,00,000/- and threatened to kill the informant unless the ransom amount is given. It is next submitted that the allegation against the petitioner is false. It is then submitted that apart from this case, the petitioner is also involved in four other cases as mentioned in para-8 of the instant bail application. It is further submitted that the petitioner has been in custody since 13.05.2026 as is evident from para-15 of the instant bail application. It is next submitted that the co- accused has already been granted anticipatory bail as mentioned in para-13 of the instant bail application. It is lastly submitted that the petitioner is ready and willing to co-operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail.
Learned counsel appearing for the State on the other hand
opposes the prayer for bail of the petitioner and submits that keeping in view the serious nature of allegation against the petitioner of commission of abduction, looting of the informant and demanding ransom by giving threatening of killing the informant as well as the criminal antecedent of the petitioner, there is every chance of the petitioner absconding and tampering with the evidence, if released on bail. Hence, it is submitted that the petitioner ought not to be released on bail. Considering the serious nature of allegation against the petitioner, his criminal antecedent as well as chance of his absconding and tampering with the evidence, if released on bail, this Court is not inclined to admit the above named petitioner to bail at this stage. Accordingly, the prayer for bail of the above named petitioner is rejected at this stage.
