1. The applicant has preferred this Second Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 138/2025, registered
2 at Police Station Ramanujnagar, District- Surajpur (CG) for the offence punishable under Section 109(1), 324(4), 103(1), 3(5) of BNS, 2023. 2. The First Bail Application bearing MCRC No. 10266 of 2025 was dismissed as withdrawn by this Court vide its order dated
12.12.2025. 3. The prosecution story in brief, is that, on 22.09.2025 at around 6:00-7:00 pm in the evening, applicant’s nephew, Karan Ravi, was sitting by the roadside near Tivaragudi. During that time, Narmada, Omprakash, and Jayprakash came there and questioned his nephew as to why he was sitting near the peanut field, and started arguing and quarreling with him. Thereafter, at about 11:00 p.m., the accused persons, with the intention to commit murder, drove their Bolero vehicle bearing registration No. CG-15-CU-7043 at a very high speed and came from the front and hit the motorcycle of the applicant’s brothers, Triveni and Rajababu, and Karan Ravi from behind, causing an accident. As a result of the said accident, his nephew Karan, Rajababu, and Karan Ravi sustained serious injuries. During the course of treatment, Rajababu died. 4. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant had no intention to cause harm or death to the deceased and the injured. The act was purely accidental. The applicant is in jail
3 since 24.09.2025 and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 5. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 6. I have heard learned counsel for the parties and perused the case diary. 7.
From the perusal of the case record, it is evident that the applicant’s nephew, Karan Ravi, was sitting by the roadside near Tivaragudi. During that time, Narmada, Omprakash, and Jayprakash came there and questioned his nephew as to why he was sitting near the peanut field, and started arguing and quarreling with him. Thereafter, at about 11:00 p.m., the accused persons, with the intention to commit murder, drove their Bolero vehicle bearing registration No. CG-15-CU-7043 at a very high speed and came from the front and hit the motorcycle of the applicant’s brothers, Triveni and Rajababu, and Karan Ravi from behind, causing an accident. As a result of the said accident, his nephew Karan, Rajababu, and Karan Ravi sustained serious injuries. During the course of treatment, Rajababu died. It appears that the accused persons, acting together and in a planned manner, intentionally hit them with the vehicle and committed the offence of murder. The act committed by the accused is of a serious nature. 4
8. Considering the facts and circumstances of the case, it does not appear appropriate to grant the benefit of bail to the applicant/accused Narmada Ravi. Therefore, the bail application filed on behalf of the applicant/accused Narmada Ravi under Section 483 of the Criminal Procedure Code is rejected. 9. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 10. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
