CORAM: HON'BLE DR. JUSTICE SWARANA KANTA SHARMA O R D E R % 07.09.2026 1. By way of the present petition, the petitioner seeks the following reliefs: “...a. Issue a writ of mandamus or such other writ, order or direction to Respondent No. 1 to convene the meeting of the Standing Technical Committee or the Local Technical Committee on or before 08.09.2026 or as expeditiously as possible to consider and decide upon procurement of Injection Opdualag (premixed formulation of Nivolumab 480 mg and Relatlimab 160 mg) as requisitioned vide application dated 19.08.2026; and to provide the same to the petitioner for administration on 08.09.2026 and to reimburse the actual cost borne by the petitioner in the first dose on 11.08.2026. b. In the alternative, issue a writ of mandamus or such other writ, order or direction allowing the Petitioner to procure the Injection Opdualag (premixed formulation of Nivolumab 480 mg and Relatlimab 160 mg) through its own resources and to direct Respondent No. 1 to consider and decide upon the grant of post facto approval of the said procurement, and reimbursement of the This is a digitally signed order. No one is present on behalf of the respondent, despite being served advance notice. 3. The petitioner has inter alia sought issuance of direction to respondent no. 1 to convene the meeting of Standing Technical Committee/ Local Technical Committee, to consider and decide expeditiously, the issue regarding procurement of injection Opdualag (premixed formulation of Nivolumab 480 mg and Relatlimab 160 mg), since the dose of the same is to be administered to the petitioner on 08.09.2026. 4. Having heard the learned counsel appearing for the petitioner, it is directed that the meeting of the Standing Technical Committee/ Local Technical Committee be convened within a period of one week from date, to decide the aforesaid issue. It is also directed that in case, prior to such meeting being held, the petitioner has already purchased the injection at his own expense, his claim thereto shall be considered by the said Committee. 5. This Court, while passing this order, has taken note of the fact that the application for procurement of the injection had been filed on 19.08.2026 and was approved by the CMO, but the patient/petitioner had to wait since the Committee did not hold its meeting. It is also expected that, in future, such matters be taken up on an urgent basis by the respondents. 6. List on 21.09.2026. 7. A copy of this order be given dasti under the signature of Court Master.
