1. Union Of India Through Secretary To Home Ministry, New Delhi
2. Director General, Central Reserve Police Force, Block No. 1, C.G.O. Complex, Lodhi Road, New Delhi - 110003
3. Deputy Inspector General Of Police, GC-I, Central Reserve Police Force, Ajmer ----Respondents For Petitioner(s) : Mr. Chain Singh Rathore, Adv. For Respondent(s) : Mr. Gaurav Jain, Adv.
HON'BLE MR. JUSTICE ANAND SHARMA
Judgment 13/01/2026
1. Petitioner has filed the instant writ petition, feeling aggrieved by denial of appointment to the petitioner on the post of Constable (GD), despite qualifying the recruitment examination, acquiring suitable place in the select list as well as clearing the Physical Efficiency Test (PET) and Physical Standard Test (PST).
2.
Learned counsel for the petitioner submits that the petitioner is member of Scheduled Caste, however, without there being any mistake on his part, the respondents themselves treated him as a member of Scheduled Tribe and accordingly, his Physical Efficiency Test and Physical Standard Test were conducted and he was found qualified in the Physical Standard Test on
[2026:RJ-JP:1362] (2 of 3) [CW-15586/2013] account of having chest measurement of 76 Cms with expansion of 5 Cms. Thereafter, he was also required to undergo the training, yet appointment letter was not issued to him, which is causing grave prejudice and miscarriage of justice to the petitioner.
3.
Learned counsel for the respondents submits that admittedly, petitioner is member of Scheduled Caste and there were altogether different parameters with regard to Physical Standard in respect of chest of the respective candidates. For SC candidates, the requirement was to have chest measurement of 80 Cms with expansion of 5 Cms, whereas such requirement was lesser for the member of Scheduled Tribe and he was required to possess chest measurement of 76 Cms with expansion of 5 Cms.
4.
Learned counsel for the respondents submits that on account of bona fide clerical error, while issuing call letter to the petitioner for Physical Standard Test, instead of SC, the category of petitioner was shown as ST and accordingly, instead of examining the Physical Standard of the petitioner treating him to be SC, he was examined for the parameters for ST candidates. Admittedly, petitioner did not possess the requisite parameters, which are otherwise meant for SC candidate. Later on when on examination of the documents as well as certificate of the petitioner, it was found that the petitioner is not member of Scheduled Tribe but is a member of Scheduled Caste, therefore, on account of not possessing the requisite chest measurement meant for SC, appointment was not granted to the petitioner.
5. Heard learned counsel for the parties and perused the record.
[2026:RJ-JP:1362] (3 of 3) [CW-15586/2013]
6. It is not disputed by learned counsel for the petitioner that the petitioner is member of Scheduled Caste and not a member of Scheduled Tribe. It is also not disputed that the petitioner could not qualify the Physical Standard Test, which is prescribed for member of Scheduled Caste and hence, the appointment was not given to the petitioner.
7. In view of above, this Court finds no error in the action of the respondents and the writ petition filed by the petitioner is hereby dismissed.
