The petitioner herein is questioning the order passed by the Deputy Commissioner at Annexure-A dated 06.11.2025, on the ground that the Deputy Commissioner could not have remanded the matter back to the Assistant Commissioner for fresh consideration. - 3 - HC-KAR NC: 2026:KHC:8108 WP No. 1671 of 2026 3. Having heard the learned counsel for petitioner, the learned High Court Government Pleader and on perusing the petition papers, this Court is of the considered opinion that there is no infirmity found in the impugned order passed by the Deputy Commissioner. The Deputy Commissioner found that the Assistant Commissioner passed an order without verifying the original Grant Register, Saguvali Chit, Issue Register etc., and accordingly, the matter has been remanded with a direction to the Assistant Commissioner to verify from the original Grant Register, the factum of the grant said to have been made in favour of the original grantee Sri.Basavaiah s/o late Narashivaiah. 4. It is the bounden and duty of the Assistant Commissioner to call for the original Grant Register, Saguvali Chit, Issue Register and verify regarding the claim made by the applicant that the land was granted in favour of Sri.Basavaiah s/o Narashivaiah. The Assistant Commissioner has to record a finding as to whether the grant was made in favour of the said person, whether he belongs to a Scheduled Caste or Scheduled Tribe Community and having regard to the date of the grant, - 4 - HC-KAR NC: 2026:KHC:8108 WP No. 1671 of 2026 what is the rule that would apply in the matter of non- alienation. 5. For the reasons stated above, since this Court is convinced that there is no infirmity in the order of the Deputy Commissioner, the writ petition stands dismissed.
