(2026:JHHC:18140) IN THE HIGH COURT OF JHARKHAND AT RANCHI B. A. No. 5582 of 2026 Animesh Samanta @ Bapi, aged about 30 years, son of late Ashok Samanta, resident of village – Aam Bagan, Fucha Konda Kai Makan New Hanuman Mandir Ka Pass, PO & PS – Mihijam, District – Jamtara.. … … …Petitioner Versus The State of Jharkhand. … … …Opp. Party ------ HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Ms. Rajni Singh, Advocate For the State : Mr. Bishambhar Shastri, Addl. P.P. ------ Order No:- 04, Dated:- 22nd June, 2026 Heard the parties. This is the second journey of the petitioner for grant of regular bail. Earlier, the prayer of the petitioner for grant of regular bail was rejected on merit. The petitioner has moved before this Court for grant of bail in connection with Mihijam P.S. Case No. 72 of 2023, registered for the offences punishable under sections 420, 467, 506/34 the Indian Penal Code. The learned counsel for the petitioner submits that the fresh ground is that the petitioner has been in custody for some more time. Hence, the petitioner may be admitted to bail. The learned Addl. P.P. opposes the prayer for bail of the petitioner and submits that since the regular bail of the petitioner has earlier been rejected on merit; in absence of any fresh ground, the mere fact that the petitioner has been in custody for some more time, is not a sufficient ground to reconsider the prayer for bail of the petitioner, which has earlier been rejected on merit, moreover as there is every chance of the petitioner absconding and tampering with the evidence, if released on bail. Hence, it is submitted that the petitioner ought not be admitted to bail. Considering the fact that there is no fresh ground for reconsideration of the prayer of the petitioner for grant of regular bail and the mere fact that the petitioner has been in custody for some more time, is not a sufficient ground to reconsider the prayer of the petitioner for grant of regular bail more so when there is chance of the petitioner absconding and tampering with evidence, if released on bail. Accordingly, the prayer for bail of the petitioner is rejected for the same grounds as mentioned in the order dated 06.12.2025 passed in B.A. No. 7320 of 2025. (Anil Kumar Choudhary, J.)
