By this application, the petitioner is seeking amendment to the petition by adding respondent No.4 – Deputy Director of Town Planning, Nagpur Municipal Corporation, as a party respondent and for consequential amendments in the pleadings as well as in the prayer clause. 3. Learned counsel Mr. Parchure for respondent No.3 has opposed the application by filing a reply, wherein he has contended that, by way of the proposed amendment, the petitioner seeks to alter his case and that the same would change the nature of the proceedings. 4. Learned counsel for respondent Nos.1 and 2 has also opposed the proposed amendment. 5. After hearing both sides and upon consideration of the application, we are of the view that the proposed amendment 69.WP.5500.2026 2/2 would not change the nature of the proceedings. Hence, the application deserves to be allowed. 6. Accordingly, the application is allowed. The amendment be carried out within two weeks from today. The amended copy of the petition be placed on record and also furnished to the respondents. 7. The civil application stands disposed of accordingly. 8. List the petition on 29th October, 2026.
