JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned Additional Government Advocate accepts notice for respondent Nos.1 to 3. 2. Petitioner is before this Court seeking for the following reliefs: a. Issue a Writ of Writ of Certiorari or any appropriate writ, order of direction to quash order bearing No. Dgï.Dgï.n.(J.eÉ)/¹.Dgï:172/202223 (R.R.T (A.J) / C.R: 172/2022-23) dated 28th February 2023, passed by 2nd Respondent, in respect of lands bearing Survey Numbers 72, 56, 71/3, 73/2, 74/1, 74/2, 57/1, 58/2, - 3 - HC-KAR NC: 2026:KHC:10941 WP No. 1615 of 2026 58/3, 64/1, 70/3 and 71/3 in total measuring 23 Acres 22 Guntas, produced as ANNEXURE-A, situated at Rajapura Grama, Jigani Hobli, Anekal Taluk, [more fully described as Schedule A Property hereunder]. b. Issue a Writ of Mandamus or any appropriate writ, order or direction to the 3rd Respondent to accept, consider and decide the Petitioner's application for issuance of E- khata, and consequently to effect and recognise the E Khata issued in respect of the converted vacant residential site bearing No.235, falling in Survey number 64/1 vide E Khata / Property ID No. 150200103200201300/240/235/2016 17 dated 4 ^ m April 2016 issued by Henagara Grahma Panchayath, Jigani Hobli, Anekal Taluk Bangalore Zilla Panchayath in a B.M.R.D.A Approved Layout known as "CELEBRITY LAKEVIEW", situated at Rajapura Village, Jigani Hobli, Anekal Taluk, Bangalore District, more fully described as Schedule - B Property hereunder] in the name of Petitioner produced as ANNEXURE-N. c. Grant cost of this Petition. d. Pass any other appropriate writ, order or direction as the Hon'ble Court deems fit to grant, under the circumstances of the case, in the interest of justice. 3. A memo dated 21.02.2026 has been filed signed by the petitioner and counsel for the petitioners, which reads as under: The counsel for the petitioner respectfully submits as follows: 1. The petitioner herein no longer wishes to pursue the present writ petition and hence wishes to withdraw the same. 2. It is further submitted that the petitioner may be permitted to withdraw the present writ petition with liberty to initiate fresh proceedings, without prejudice to all rights and contentions of he petitioner. WHEREFORE, in the above circumstances, it is most respectfully prayed that this Hon'ble Court may be pleased to permit the petitioner to withdraw the - 4 - HC-KAR NC: 2026:KHC:10941 WP No. 1615 of 2026 present writ petition, reserving liberty as prayed for, in the interest of justice and equity." 4. Accepting the said memo, petition is dismissed as withdrawn. 5. Liberty is reserved to file a fresh petition, if any other cause of action arises.
