Since all the writ petitions are filed against the orders of the District Registrar, Vijayawada, dismissing the appeals preferred against the orders of the Joint Sub-Registrar, Vijayawada, in refusing to register the sale deeds of the flats, with the consent of all the parties, the writ petitioner, learned Government Pleader for Revenue appearing for the official respondent Nos.1 to 3 and Mr. M.R.K.Chakravarthy, learned counsel for the unofficial respondent Nos.4 to 6, they are heard together and they are being disposed of by this common order. 3. Heard Mr. D.Srinivas Prasad, learned counsel for the writ petitioner, learned Government Pleader for Revenue appearing for the official respondent Nos.1 to 3 and Mr. M.R.K.Chakravarthy, learned counsel for the unofficial respondent Nos.4 to 6. 4. The writ petition No.4785 of 2020 is taken as a lead case in this batch of writ petitions. The unofficial respondent Nos.4 to 6 are the owners of the land in question in an extent of 7.00 acres covered by survey Nos.399 and 399/1 situated at Atmakuru Village of Mangalagiri Mandal of Guntur District. The writ petitioner-Manjeera Construction Limited entered into a development agreement with the land owners, who are the unofficial respondent Nos.4 to 6, for construction of an apartment in the name and style Manjeera Monarch. As per the terms of the said development agreement, a supplementary registered agreement has to be executed between the developer/builder and the land 25 CMR,J & GTK,J W.P.Nos.4724, 4737, 4738, 4739, 4741, 4779, 4782, 4785, 4789, 4791 and 4799 of 2020 owners, determining the share of the apartment that may fall to the share of the builder and the owners of the land. The said supplementary registered agreement was not executed, specifying and determining, as to which flats in the apartment that was constructed fell to the share of the builder and the owners of the land. However, after construction of the apartment, in view of the General Power of Attorney that was executed in favour of the builder by the land owners, he has presented a sale deed executed in favour of respondent Nos.7 and 8 in these writ petitions, in respect of a flat purchased by them, for registration. Initially, the sale deed was presented before the Joint Sub-Registrar of Mangalagiri. He refused to register the sale deed on the ground that the share of the apartment as well as the common area that fell to the shares of the flat owners are not determined. Thereafter, the writ petitioner, who is the builder, has presented the said sale deed before the Joint Sub-Registrar, Vijayawada. He has also refused to register the sale deed on the same ground. Aggrieved by the said refusal to register the sale deeds by the Joint Sub-Registrar, Vijayawada, the writ petitioner has preferred an appeal before the District Registrar, Vijayawada. The District Registrar, Vijayawada, by the impugned order, has confirmed the orders of the Joint Sub-Registrar, Vijayawada, in refusing to register the sale deeds on the ground that the shares of the flats that fell to the share of both the builder and the owners of the land are not specified and the common area that fell to the share of flat owners is also not specified. 5. Aggrieved, the writ petitioner has filed these writ petitions, assailing the impugned orders of the District Registrar, Vijayawada, confirming the orders of the Joint Sub-Registrar, Vijayawada, in refusing to register the said sale deeds on the aforesaid grounds. 6. We have meticulously gone through the Development Agreement-cum- General Power of Attorney that was executed by the unofficial respondent Nos.4 to 6-land owners in favour of the writ petitioner-Manjeera Construction 26 CMR,J & GTK,J W.P.Nos.4724, 4737, 4738, 4739, 4741, 4779, 4782, 4785, 4789, 4791 and 4799 of 2020 Limited. Clause 2.4 of the said Development Agreement-cum-General Power of Attorney is relevant in the context to consider to resolve the controversy involved in these writ petitions. It reads thus: 2.4 It is hereby agreed and understood that within 30 days of finalization of Plans by the Developer for the Residential complex (Apartments) separately for each Phase, both the parties shall exchange written communication setting out the details of the allocation of the Apartments falling to their respective shares which shall be reduced into writing in the form of a registered Supplementary Agreement at the expense/cost of the owners for the purpose of dealing with the Apartments falling to their respective shares as their own property and shall be entitled to all income, gains, capital, appreciation and benefits of all kinds accruing or arising from or in relation thereto. However, at the time of sharing, the Parties shall be given due account to the advantages/disadvantages in proportion to their respective shares. It is hereby agreed that the Developer shall construct the Apartments as per the specifications mentioned in Annexure-C. 7. Thus, it is evident from the aforesaid clause that within thirty days of finalization of plans by the developer for the residential complex (apartment), separately for each phase, both the parties shall exchange written communication setting out the details of the allocation of the apartments falling to their respective share, which shall be reduced into writing in the form of a registered supplementary agreement at the expense of the owners for the purpose of dealing with the apartments falling to the respective shares as their own property. 8. Therefore, as per the terms of the aforesaid development agreement, a supplementary agreement has to be executed between both the parties setting out the details of the allocation of the flats falling to their respective shares and a registered supplementary agreement in writing to that effect has to be executed at the cost of the owners for the purpose of dealing with the flats of the apartment falling to their respective shares. Therefore, after construction of the apartment, they have to allocate the shares of the flats that 27 CMR,J & GTK,J W.P.Nos.4724, 4737, 4738, 4739, 4741, 4779, 4782, 4785, 4789, 4791 and 4799 of 2020 fell to the share of both the developer and the land owners and a registered supplementary agreement has to be executed to that effect. However, the shares of the flats that fell to the shares of both the developer and the land owners are not determined and allocated and no registered supplementary agreement was executed. The same was also not presented before the Joint Sub-Registrar or the Registrar. Therefore, the objection that was taken by the land owners before the Registrar that, as the shares of the flats of the apartment between the developer and the owners of the land are not determined and allocated was rightly entertained by the Registrar and refused to register the sale deeds. We absolutely do not find any legal flaw or infirmity in the impugned orders passed by the District Registrar, Vijayawada, in refusing to register the said deeds. Unless and until the shares of the flats in the apartment are allocated and specified, the developer cannot, taking advantage of the General Power of Attorney that was executed in its favour, sell the flats to the third parties. It may create further legal complication and affect the rights of the third parties, who purchase the flats without allocation of the shares of the flats in the apartment between the builder and the land owners. Therefore, the Joint Sub-Registrar, Vijayawada, has rightly refused to register the sale deeds, as the shares of the flats are not determined and allocated and as the common area that fell to the share of each flat owner is also not specified and determined. The District Registrar, Vijayawada, has also rightly confirmed the orders of the Joint Sub-Registrar, Vijayawada, in refusing to register the sale deeds. Therefore, the impugned orders of the District Registrar, Vijayawada, in confirming the orders of the Joint Sub- Registrar, Vijayawada, in refusing to register the sale deeds on the aforesaid grounds are perfectly sustainable under law and they warrant no interference in these writ petitions and they are not liable to be set aside. 9. It is significant to note that even as on today also, the writ petitioner/builder did not produce any copy of the registered supplementary 28 CMR,J & GTK,J W.P.Nos.4724, 4737, 4738, 4739, 4741, 4779, 4782, 4785, 4789, 4791 and 4799 of 2020 agreement before the Court to ascertain whether the shares of the flats between the builder and the land owners in the said apartment are determined and allocated and whether the common area that is allotted to each flat owner is specified or not. 10. Learned counsel for the writ petitioner would contend that recently after filing of these writ petitions a supplementary agreement was executed between the owners of the land and the builder and it was registered on 23.02.2026. But a copy of the same is also not produced before this Court to examine the same. If any such supplementary agreement was executed and registered, allocating the shares of the flats in the apartment between the builder and the owners of the land and shares are specified then the defect stands cured and it clears the obstacles and impediment for registration of the sale deeds in favour of the purchasers of the flats. Learned counsel for the unofficial respondent Nos.4 to 6 pleaded ignorance of the fact that any such registered supplementary agreement was executed. If any such registered supplementary agreement in terms of clause 2.4 of the Development Agreement-cum-General Power of Attorney dated 24.09.2015 was executed, the writ petitioner or the subsequent developer, who replaced the writ petitioner and entered into its shoes, is at liberty to present the sale deeds that are executed in favour of the third parties-purchasers of the flats before the Sub-Registrar and if it is otherwise in order, the same may be entertained by them and effect registration of the sale deeds. In fact, learned counsel for the unofficial respondent Nos.4 to 6-land owners also conceded that if any such registered supplementary agreement was executed that the subsequent developer, who has taken over the responsibility from the writ petitioner- Manjeera Construction Limited, as per the resolution plan executed before the NCLT Bench-II, Hyderabad, is at liberty to present the sale deeds for registration. 29 CMR,J & GTK,J W.P.Nos.4724, 4737, 4738, 4739, 4741, 4779, 4782, 4785, 4789, 4791 and 4799 of 2020 11. Therefore, these writ petitions are dismissed, affirming the impugned orders of the District Registrar, Vijayawada, which are impugned in these writ petitions. However, in view of the subsequent events that took place, as stated by the learned counsel for the petitioner relating to execution of the registered supplementary agreement, they are at liberty to present the sale deeds for registration before the concerned Sub-Registrar. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed. ________________________________________ JUSTICE CHEEKATI MANAVENDRANATH ROY _____________________________ JUSTICE TUHIN KUMAR GEDELA Date: 26.02.2026 MDP
