Shastri, A.P.P. ------ 06/ 22.06.2026 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Rikhiya P.S. Case No. 190 of 2025, registered for the offence under Section 303(2) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Deoghar. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the name of this petitioner has come on the basis of confessional statement. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner. 4. Learned A.P.P. has opposed the prayer and submits that the petitioner is the accomplice of the said person, from whom, one motorcycle in question has been recovered and the petitioner is also an accused in another case being Rikhiya P.S. Case No. 189 of 2025 which is also registered for another motorcycle. He next submits that the theft motorcycle of the present case was also found behind the house of the petitioner and the said house was found to be locked. On these grounds, he submits that anticipatory bail may kindly be rejected. [2026:JHHC:18183] -2- 5. Considering that the petitioner is also an accused in other case of the same nature and further the theft motorcycle of the present case has been found behind the house of this petitioner and the said house was found locked and in the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, above named.
