(ORAL) A decree of specific performance was passed ex parte by the trial Court on 03.08.2023 against defendant- peoner, in favour of respondent No.1- plainff. The peoner had been directed to execute the sale deed and get it registered in favour of the plainff- respondent No.1 within a period of 03 months. Learned counsel submits that sale deed has since been executed by the peoner, copy of which is Annexure P-3 but balance sale consideraon has not been received by the peoner. Learned counsel also submits that balance sale consideraon was deposited by the respondents before the trial Court and the applicaon (Anenxure P-1) was moved for seeking the withdrawal of the amount as deposited by the respondent/decree-holder but ll date no order has been passed. The simple prayer made by learned counsel is to direct the concerned Execung Court for permi2ng the withdrawal of the amount as deposited by the decree-holder.
