(ORAL) Peoner is the defendant in Commercial suit No.136 of 2025 tled ‘Snowman Logiscs Limited vs. Coldserve Innovaons Private Limited and another’, pending before learned Commercial Court, Gurugram. 2. Peoner is aggrieved by the two orders both dated 23.02.2026 (Annexures P-1 & P-6), whereby his defence was struck off and the applicaon for permi;ng him to take on record the wri<en statement as filed later on the same date, was declined. 3. It is conceded by learned counsel that the meline of 120 days for filing of the wri<en statement in the commercial suit had already expired when the applicaon was moved seeking permission to file the wri<en statement on 23.02.2026. Learned counsel submits that an applicaon under Order 7 Rule 11 CPC was pending. However, this itself cannot be a ground not to file the wri<en statement within the statutory period of 120 days. 3. In the circumstances, this Court does not find any illegality or perversity in the impugned orders. 4. No merits.
