IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend the operation of the orders in Rc. No. B4/693/2025 dt. 11.6.2025 and consequently direct the respondents to hand over the charge of Shop No. 1283021 of Kalyanadurgam and pass Counsel for the Petitioner:

The Court made the following order: Assailing the show cause notice vide Rc.No.B4/693/2025 dated 11.06.2025 issued by respondent No.2-Revenue Divisional Officer, Kalyandurg, the present Writ Petition is filed. 2. Heard Sri Kasa Jaganmohan Reddy, learned counsel for the petitioner and Sri Appasani Vineeth, learned Assistant Government Pleader for Civil Supplies appearing for the respondents. 3.
Learned counsel for the petitioner, while reiterating the contents of the writ affidavit contended that the petitioner was appointed as permanent dealer to the subject shop. He further contended that respondent No.2 issued the impugned show cause notice alleging that the card holders made certain vague and unsubstantiated allegations against the petitioner regarding the weights and rates, epos, voice over etc., and sought explanation, for which the petitioner submitted his explanation on 28.07.2025. He further submitted that the respondents neither furnished any material substantiating charges nor passed any orders on the proceedings initiated against him and stopped supplying of essential commodities to the Fair Price Shop of the petitioner. He further contended that stoppage of supply of essential commodities without suspension or cancellation of the Fair Price Shop authorization is illegal and arbitrary as per the order passed by the Full Bench of High Court in Oleti Tirupathamma Vs District Supply Officer (city) Visakhapatnam and others1. Hence, prayed to allow the writ petition.

4. On the other hand, Sri Vineeth Appasani, learned Assistant Government Pleader, fairly conceded that the authorities cannot stop supply of essential commodities, unless the FP shop authorization of the petitioner is either suspended or cancelled and in the instant case, there was neither suspension nor cancellation of the authorization and the authorities, if intend, would take steps in accordance with law against the irregularities, if any, committed by the petitioner.
5. Perused the material available on record and considered the
submissions made by learned counsel for the parties.
6. As rightly contended by the learned counsel for the petitioner and fairly conceded by the learned Assistant Government Pleader, there is neither suspension nor cancellation of the FP shop authorization of the petitioner. Therefore, stoppage of supply of essential commodities for being distributed to the cardholders allocated to the FP shop of the petitioner is unsustainable.
7. In view of the above, the writ petition is disposed of, directing the authorities to continue to supply the essential commodities to the FP shop of the petitioner. In case the respondent authorities intend to take action against the irregularities, if any, committed by the petitioner, they can take steps in accordance with law. There shall be no order as to costs.
As a sequel thereto, interlocutory applications pending, if any in the Writ Petition, shall also stand closed. ____________________________ JUSTICE RAVI CHEEMALAPATI 20.02.2026 MP
