Dutta, learned counsel for the petitioner and Mr. D.P.Goswami, Page No.# 2/4 learned Additional Public Prosecutor, for the State respondent. 2. The petitioners 1. Miladul Islam Ahmed @ Ruman and 2. Nawaj Ahmed have filed this application under Section 483 of the BNSS, 2023 with a prayer for bail as they are behind bars since 22.11.2025 in connection with Silchar P.S. Case No. 1164/2025 under Sections 61(2)/140(3)/308(5) of BNS, 2023. 3. The gist of the allegations in the FIR is that the informant along with his friend Sahan Ahmed had come to Silchar for some work and thereafter, one Shah Alom Mazarbhuiya came and asked the informant to sit inside his vehicle along with four other persons. Thereafter, he was taken to various locations and they demanded Rs. 7 lacs from him for his release. It is alleged that the persons had kidnapped him. 4. The learned counsel for the petitioners drawing attention to paragraph-6 of the bail petition submits that the informant and his close friend Sahan Ahmed had borrowed money of Rs.7,00,000/- from the accused Sah Alom Mazarbhuiya for business purpose but they could not return the money timely. So, the accused requested the informant and his close friend again and again to return the money but they did not agree to return the same and in the context of the same, there was some altercation whereafter, with false allegations, the FIR was lodged. 5. The present petitioners were arrested on 22.11.2025. 6. Case Diary has been received. 7. The learned Additional Public Prosecutor submits that investigation has revealed that they demanded Rs. 7 lakhs from the informant and used force against him. Page No.# 3/4 8. Perused the statement of two witnesses recorded before learned JMFC during investigation. Firstly, the investigation reveals some implicating materials against the accused persons with regard to the allegations. Nevertheless, I also find that the aforementioned Sah Alom Mazarbhuiya was granted interim protection by order dated 16.12.2025 passed in AB 2940/2025. 9. Considering the length of detention and the circumstances from which the present case has arisen, I am of the considered that the petitioners should be granted bail at this stage. 10. In view of the above, the accused petitioners named above are hereby allowed to go on bail of Rs.30,000/- each with one surety each of like amount to the satisfaction of the learned CJM, Cachar, Silchar subject to the following conditions: 1. The petitioners shall co-operate with the remaining part of investigation, 2. The petitioners shall not hamper or tamper with the evidence in any manner. 8. On violation of any of the above conditions, the learned court below is at liberty to cancel bail granted to the petitioners. 9. The bail application stands disposed of. 10. Send back the Case Diary.
