The learned counsel appearing for respondent no. 1 places on record an office order dated 31.08.2026 issued by the Ministry of Road Transport and Highways, which reads as under: “Subject: Withdrawal of order declaring Catastrophic Event at Km 105+220 on the Four-Laning of Poondiankuppam-Sattanathapuram Section of NH-45A (New NH-32) in the State of Tamil Nadu under Hybrid Annuity Mode.- reg. The failure of the Reinforced Soil (RS) wall structure of the Light This is a digitally signed order. The Order is downloaded from the DHC Server on 07/09/2026 at 14:03:09 Vehicle Underpass (LVUP) at Km 105+220 on the Kollidam Bypass of the Poondiankuppam-Sattanathapuram Section of NH-45A in the State of Tamil Nadu, being implemented by M/s Oriental Structural Engineers Private Limited (Concessionaire), was declared as a Catastrophic Failure by the Competent Authority, vide Order No: TNDIV-21011/24/2026-Tamil Nadu Division dated 04.08.2026 (copy enclosed). 2. In pursuance of the directions of the Secretary, Ministry of Road Transport & Highways, dated 31.08.2026, the Order dated 04.08.2026 is hereby withdrawn. 3. The matter shall be considered afresh by the Competent Authority after providing for a hearing to M/s Poondiankuppam Sattanathapuram Section Private Limited (Promoters - M/s Oriental) for making its submissions before arriving at a determination regarding declaration of the aforesaid failure as a Catastrophic Event in terms of the Ministry's Circular No. RW/NH - 24036/28/2025- BP&SP, dated 22.12.2025 read with Circular No. RW/NH- 33044/05/2026-S&R (P&B) dated 02.03.2026.” 2. In view of the above office order, the prayers made in the present writ petition stand satisfied. 3. Accordingly, the present writ petition stands disposed of. Pending application, if any, also stands disposed of. 4. In case of any further grievance, the petitioners are at liberty to approach this Court again by filing a fresh writ petition. 5.
