Preliminary objection has been raised by learned counsel for the respondents that the present petition under Article 227 of the Constitution of India is not maintainable. He submits that against the dismissal of the application under Section 5 of the Limitation Act by the learned Additional District Judge, Sakaghat, District Mandi, H.P., the remedy available to the present petitioner is the appeal.

Faced with this situation, learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file appropriate appeal in accordance with law.
