Accordingly, we dispose of the present writ petition with the direction to respondent No. 2 (Director, School Education) to take a decision on the said representation and pass a speaking order within four weeks from the receipt of this order, ensuring that the interest of the students in the said school is duly taken care of.” 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes 2 CWPIL No. 25 of 2026 decided on 24.03.2025 - 2 - 2. Learned Assistant Advocate General has placed on record copy of consideration order passed by the respondents on 23.07.2026, in terms of which, vide office order dated 10.07.2026, a Trained Graduate Teacher (TGT) (Non Medical) (N.M.) has been posted against the vacant post at Government Middle School Thensar u/c GSSS Baryogi, District Mandi. The TGT has reportedly joined on 14.07.2026. The consideration order further states that the vacant posts of Drawing Teacher and Physical Education Teacher at GMS Thensar are not required to be filled in as per norms and standards prescribed under the Right of Children to Free and Compulsory Education Act, 2009. And also in view of the approval conveyed by the Government vide letter dated 19.11.2018, vacant posts of Drawing and Physical Education Teachers in standalone Government Middle Schools having enrolment below 100, have been kept in the pool and are, therefore, not liable to be filled separately; That in compliance to the directions issued in Himachal Devi and others2, the vacant post of TGT (N.M.) at GMS Thensar, Sub Tehsil Chhatri, District Mandi, has been filled up. The issue regarding remaining vacant posts has also been examined - 3 - in accordance with the provisions of Right of Children to Free and Compulsory Education Act, 2009 as also Government instructions dated 19.11.2018. 3. Taking note of the above office instructions and the consideration order dated 23.07.2026, the present contempt proceedings are closed. Notice issued to the respondent is discharged. Petitioners, if still feel aggrieved, are at liberty to seeks appropriate remedy for the redressal of their surviving grievances, if any, in accordance with law.
