Reliance is placed upon the pendency of LPA No. 761 of 2025 and the interim order which was passed at the initial stage on 28th October, 2025, to submit that the petitioners were similarly situated to the extent that they were not parties to the case before the learned Single Judge and have come to know that the seniority list is going to be redrawn as per the communication dated 4th July, 2026, a photocopy of which has now been placed on record. In such circumstances, the application for leave to appeal has been filed. In the case in hand, the writ petitioners were appointed on contract basis in the year 2010 and were regularized in 2017, whereas the applicants are appointees of 2004 and were regularized in 2014, and therefore, would be placed above the appellants.
For the reasons stated in the application, leave to appeal is granted. Application stands disposed of.

Keeping in view the averments made in the application, duly supported by the affidavit of the official, delay of one year and 286 days in filing the appeal is condoned.

We are of the considered opinion that prima facie a case is made out in favour of the applicants for grant of stay of the impugned judgment. Accordingly, operation and execution of judgment dated 4.10.2024 passed in CWPOA No. 1695 of 2019 titled Ajay Kumar Thakur and others vs. State of H.P. and another shall remain stayed.
