Petitioners herein seek quashing of FIR No. 267/2017 dated 07.06.2017, registered at Police Station Tilak Nagar, for commission of offences under Sections 308/506/34 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. The abovesaid FIR was registered on the basis of complaint made by Jitender @ Bittu. He had come to Mangal Bazar, Tilak Nagar to meet his friends- Durgesh Kumar Saxena and Mohit Saxena and the accused persons attacked him and his friends. In the abovesaid assault, Jitender and his abovesaid two friends received injuries. 3. After requisite investigation, a charge-sheet was filed before the concerned Magisterial Court and the trial is underway. It is also informed that Digitally Signed By:SONIA THAPLIYAL Signing Date:05.09.2026 12:32:34 Signature Not Verified CRL.M.C. 1501/2026 2 a cross FIR was also registered which was given number as 268/2017 registered at PS Tilak Nagar for committing offences under Section 323/506 IPC. 4. The quashing is, however, being sought for the reasons that the parties have amicably settled all their disputes. 5. Copy of Settlement Deed/Compromise Deed notarized on 07.01.2026 has also been placed which records that with the intervention of respectable persons, elders of the family and well-wishers, parties have been able to resolve their all disputes. As per the terms of the settlement, both the sides have undertaken to settle both the abovesaid criminal cases i.e. case in hand as well as the other connected FIR i.e. FIR no. 268/2017. 6. It is submitted that due to some oversight, the number has not been recorded correctly in the Settlement Deed. However, during course of arguments, copy of one order has been shown which clearly indicates that the cross case FIR is FIR No. 268/2017. Copy of such order dated 18.03.2024 passed by learned Sessions Court, which is common with respect to both the abovesaid criminal cases, is retained on record. 7. Both the parties undertake to comply with the terms of settlement. 8. Petitioners herein also undertake that they would make appropriate statements before the learned Court of Sessions for seeking permission to compound the offences with respect to FIR No. 268/2017. 9. All the three injured are present in person and are duly identified by their counsel as well as Investigating Officer (I.O.) and they reiterate that the matter has been amicably settled and they are no longer interested in pursuing FIR. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioner. 11. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR. 12. Consequently, to secure the ends of justice, FIR No. 267/2017 dated 07.06.2017, registered at Police Station Tilak Nagar, for commission of offences under Sections 308/506/34 IPC, along with all consequential proceedings arising therefrom, is, hereby, quashed. 13. Original affidavits and MoU of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within four weeks from today, so that these become part of Trial Court Record. 14. The petition stands disposed of in aforesaid terms. 15. Other pending application also stands disposed of in aforesaid terms.
