The petitioner, above-named, who is in custody since 01.06.2025 in connection with Katkamsandi (Hazaribag) P.S. Case No. 122/ 2025 for the offence registered under Sections 103(1), 303(2), 3(5) of BNS, 2023 has prayed for regular bail. As per the prosecution case, informant is the elder brother of the deceased and as per the FIR, the deceased had left his home at 6 o’clock in the morning and at that time he has Rs.5,000/- in cash with him. When he did not return by 12 o’clock, the family members went in search of his whereabouts in which it transpired that he was seen going along with three persons on a Splendor Motorcycle. The informant apprehended that the petitioner and three others had robbed him the cash and killed and disposed of his dead-body. It is submitted by the learned counsel on behalf of petitioner that there is no direct or circumstantial evidence of the alleged offence. The motive of the offence has also not been disclosed and except the confessional statement, there is no material against him. It is further submitted that the death was accidental in nature and the petitioner has no role in the alleged occurrence and all the five persons had taken liquor in the morning as per Para-64 of the case diary. Learned A.P.P. for the State assisted by learned counsel for the informant has vehemently opposed the prayer for bail. It is submitted that the deceased was last seen with the petitioner on the motorcycle. The parts of the motorcycle have also been found from the place of occurrence. The deceased was mercilessly beaten up and 12 external 2026:JHHC:3559 2 injuries were found in the PM report.
