Issue notice. Mr. Anubhav Gupta, learned Panel Counsel accepts notice on behalf of respondent/GNCTD. 5. Briefly stated the facts of the present case are that the petitioner married Tarsem Singh, the only son of Joginder Singh and Harbhajan Kaur, on 11.01.2012. Tarsem Singh unfortunately expired on 20.12.2012. Thereafter, Joginder Singh expired on 02.07.2017, leaving behind the petitioner and her mother-in-law, Harbhajan Kaur, as his only legal heirs. Subsequently, upon the demise of Harbhajan Kaur on 30.07.2024, the petitioner became the sole surviving legal heir in respect of the estate in question. It is stated that in the interregnum, the petitioner was forcibly dispossessed by her relatives from the said matrimonial property. It was thereafter discovered that two sale deeds dated 17.08.2021 and 01.09.2021 had been executed in favour of Hunny Singh in respect of the property. The aforesaid sale deeds appear to have been executed on the basis of a Surviving Member Certificate bearing No. 90660000087013, issued by the office of DM, Alipur, wherein the petitioner's status as a legal heir was suppressed and the mother-in-law of the petitioner was incorrectly shown as the sole surviving legal heir. It is the petitioner's case that the Surviving Member Certificate was procured by deliberately suppressing material facts regarding the petitioner's status as a legal heir and, further, that the same was issued by an authority lacking the requisite territorial jurisdiction. The petitioner further submits that the sale transactions are prima facie tainted by fraud, particularly in view of the circumstances indicating that the sale consideration purportedly paid to Hunny Singh, or his relatives, was subsequently returned, thereby raising serious questions regarding the genuineness and bona fides of the said transactions.
