The petitioners have filed this writ petition challenging the order passed in Crl.Misc. No.2393 of 2025 under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, ‘the Act’) by the learned III Additional Chief Judicial Magistrate, Bengaluru. 2. The petitioners have an equal and efficacious remedy under the Act. Despite the same, the petitioners, without exhausting the efficacious remedy, have filed - 4 - HC-KAR NC: 2026:KHC:9772 WP No. 30460 of 2025 this writ petition, as such, the writ petition filed by the petitioners is not maintainable. 3. On 03.02.2026, the petitioners had undertaken to vacate the premises in question within 3 months from the date of passing of the order. The undertaking was placed on record. 4. Now, the petitioner orally undertakes to vacate the premises in question within three months from 03.02.2026. 5. As the petitioners have undertaken to vacate the premises within three months from 03.02.2026, in view of the same, the writ petition is disposed of directing the respondents not to evict the petitioners from the premises in question for three months from 03.02.2026. 6.
