JUSTICE M.I.ARUN ORAL ORDER Petitioner has filed the instant writ petition alleging that respondent no.4 has put up construction in violation of building bye-laws and sanction plan and that respondent no.4 is the neighbour of petitioner. It is further submitted that inspite of his request, no action has been taken against respondent no.4 - 3 - HC-KAR NC: 2026:KHC:14793 WP No. 31091 of 2025 by respondent nos.1 to 3-Bruhat Bengaluru Mahanagara Palike (BBMP), now Greater Bengaluru Authority (GBA). 2. Learned counsel for respondent no.4 upon instructions submits that petitioner has also put up construction in violation of building bye-laws and the sanctioned plan. 3. Learned counsel for respondent nos.1 to 3-BBMP now Greater Bengaluru Authority (GBA) upon instructions, submits that pursuant to filing of the writ petition, an inspection has been conducted and it is found that respondent no.4 has put up construction in violation of building bye-laws and sanctioned plan. He also submits that the GBA will also inspect the property of the petitioner and if it is found that the petitioner also has put up construction in violation of building bye-laws and sanctioned plan, action will be initiated against the petitioner also. His submission is placed on record. 4. No citizen has a right to put up construction in violation of building bye-laws and sanctioned plan. Hence, the writ petition is hereby disposed of with a direction to GBA to initiate appropriate action against both petitioner as well as respondent no.4 if they have put up an illegal construction - 4 - HC-KAR NC: 2026:KHC:14793 WP No. 31091 of 2025 without obtaining necessary plan sanction and in violation of building bye-laws.
